Any transaction entered into with the Bank is subject to the terms and conditions contained in the Terms and Conditions for Banking and Trade Finance Facilities and the Account Terms and Conditions as signed and delivered to the Bank by me/us. 2. The available quoted rate by the Bank is to be determined by the Bank in its sole discretion and unless agreed otherwise, I/we authorize the Bank to purchase and/or sell the Transaction Amount at the exchange rate made available by the Bank. Acknowledgement 3. A transaction may be concluded in writing, facsimile, email (or other electronic means) or by telephone instructions from any of the authorised signatories appointed by me/us as provided in the relevant documentation with the Bank. The notice of confirmation of any transaction issued by the Bank shall, in the absence of manifest error, be deemed conclusive and binding on me/us as to the particulars of the relevant transaction. 4. The Bank is authorized to debit the above-mentioned account and any other account held with the Bank, from time to time, for an amount equal to the Transaction Amount and any applicable fees and charges.
